Their parking charge is therefore £90 or £1 (or whatever) for immediate payment. This seems to be an unfair contract. Has anyone tried this approach in a small claims court? The other approach is to point out the customer has not signed a contract, and that the advertised price is fair if the service is used. If not used then why are they charging an unfair price for a service, parking a vehicle, when just stopping. The highway code distinguishes between stopping and parking. On private land they can make up their own rules, but strictly within the rule of law.
